Extensions and Integrations Framework

Nayax provides access to an extension marketplace (the “Extension Store”) through which Customer may access and install various third-party services, applications, and extensions (collectively, “Third-Party Extensions”). Access to and use of the Extension Store and any Third-Party Extensions may be subject to additional fees as set forth in the Extension Store or in a separate Order Form. By accessing the Extension Store or installing any Third-Party Extensions, Customer hereby expressly acknowledges, consents to, and agrees to be bound by (i) the applicable third-party provider’s terms of service, end user license agreements, privacy policies, and other terms and conditions that govern such Third-Party Extensions (collectively, “Third-Party Terms”), as presented in the Extension Store or on the third-party provider’s website, and (ii) any Nayax terms applicable to the Extension Store.
Customer acknowledges and agrees that Customer’s use of Third-Party Extensions is entirely at Customer’s sole risk and discretion. Customer shall be solely responsible for determining the suitability of any Third-Party Extensions for Customer’s specific business needs, territorial requirements, regulatory compliance, and applicable jurisdictional constraints. Additional configuration, customization, or settings adjustments may be required for the proper functioning of Third-Party Extensions with the Nayax Services, and Customer shall bear sole responsibility for implementing and maintaining such configurations.
Notwithstanding anything to the contrary contained herein, Nayax expressly disclaims any and all representations, warranties, or guarantees, whether express, implied, or statutory, regarding the functionality, reliability, availability, performance, or compatibility of any Third-Party Extensions. Customer shall promptly notify Nayax of any material changes, updates, or modifications to Third-Party Extensions that may affect their interaction with the Nayax Services. While Nayax shall use commercially reasonable efforts to maintain compatibility, Nayax does not warrant or guarantee continued compatibility.
In no event shall Nayax be responsible or liable, directly or indirectly, for any damage, loss, cost, or expense of any kind whatsoever caused or alleged to be caused by or in connection with Customer’s use of or reliance upon any Third-Party Extensions. Customer hereby agrees to defend, indemnify, and hold harmless Nayax, its affiliates, subsidiaries, directors, officers, employees, agents, and assigns from and against any and all claims, actions, demands, liabilities, judgments, settlements, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to Customer’s use of Third-Party Extensions. Nayax reserves the right, in its sole discretion, to disable or restrict access to any Third-Party Extensions that, in Nayax’s reasonable opinion, adversely affect the performance, security, or integrity of the Nayax Services, or that violate applicable laws or the terms of this Agreement.
